Brand My Whatever is a listing and introduction service operated by Amy Wilkinson in the Netherlands. We do not sell placements, process payments, hold funds, guarantee outcomes, or become a party to agreements between posters and sponsors.
Who may use the service
You must be at least 18. When publishing, you must state whether you act as a private individual or as a business or professional trader. That status appears on the listing. If a private individual is actually acting commercially, consumer law may still treat them as a trader.
What you may list
You may list an object, vehicle, property, gear, or project that you own or lawfully control and on which you can place approved brand material. You must have every permission required from co-owners, landlords, lenders, employers, venues, platforms, insurers, or public authorities.
Listings cannot involve people, minors, animals, body placements, illegal activity, counterfeit or infringing material, stolen property, scams, impersonation, harassment, private information, hate or sexual content, weapons, tobacco, vaping, drugs, political campaigning, unsafe placements, or products and services that require regulatory approval we have not expressly accepted.
Your listing and claims
You are responsible for the accuracy of your photos, ownership and permission claims, audience, reach, availability, dates, prices, measurements, and performance claims. Do not upload confidential material or content you do not have the right to use. Reach, impressions, sales, publicity, and return on investment must never be presented as guaranteed unless the final parties independently verify and contract for them.
Offers and final deals
Every offer, reservation request, or displayed amount on Brand My Whatever is a non-binding expression of interest. No auction winner or contract is created on the platform. A contract exists only when the poster and sponsor separately agree final terms. They are responsible for due diligence, identity checks, creative approval, production, installation, insurance, tax, payment, licences, compliance, safety, removal, and restoration.
Performance and disputes
Failure to reply, pay, install, publish, maintain, remove, or otherwise perform a final deal is a matter between the poster and sponsor. Brand My Whatever does not adjudicate performance, collect debts, provide escrow, or issue transaction refunds because it does not receive transaction funds. We may preserve relevant platform records, restrict listings, or suspend repeat offenders.
Reporting and moderation
Anyone may report specific illegal or prohibited content using the report control on the relevant listing. Reports must identify the content, explain the issue, provide contact details, and confirm a good-faith belief that the report is accurate. We review reports in a timely, diligent, and non-arbitrary way. We may reject, hide, restrict, or remove content and will explain moderation decisions and available next steps to affected users when contact details are known.
No guarantees and platform responsibility
We do not guarantee a sponsor, response, user identity, legal compliance, impressions, sales, publicity, income, or successful performance. Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, Brand My Whatever is not responsible for user content, off-platform agreements, indirect losses, or the conduct of posters and sponsors.
Suspension and changes
We may reject or remove listings, restrict access, or stop offering the service to protect users, comply with law, or enforce these terms. Significant changes will be dated here. Dutch law applies, without removing any mandatory consumer rights or protections that apply in your country.
